By submitting a design to Great West Promotions Inc. or using logos at your instruction, you warrant and represent that you are the sole legal owner or licensee of all rights, including copyright, to each copyright, trademark, service mark, trade name, logo, statement, portrait, graphic, artwork, photograph, picture or illustration or any other intellectual property included in such design.
Further you warrant and represent that no part of the design: (a) violates or infringes upon any common law or statutory right of any person or entity, including, but not limited to, rights relating to copyrights, trademarks, contract rights, moral rights or rights of public performance; (b) is the subject of any notice of such infringement you have received; or (c) is subject to any restriction or right of any kind or nature whatsoever which would prevent Great West Promotions Inc. from legally reproducing the images or text submitted.

Over Runs and Under Runs
In certain instances you may receive an overage or a shortage on your order.
Due to manufacturing quality and production standards there will be over runs and occasionally under runs. Great West Promotions Inc. will do everything possible to reduce this occurrence. The industry standard on most products is ± 10%. For instance, if you order 1,000 mugs you could potentially receive between 900 and 1,100 mugs. Exceptions to the above are paper and plastic bags, which may vary ± 25%.

Artwork Design and Modification
Great West Promotions Inc. inspects all artwork submitted to make certain that it meets the specific requirements for applying your design to the products you selected. If minor modifications are required, we will make these free of charge with your permission.
Billable
For significant modifications that exceed 1 hour, we provide art services at $60.00 per hour. At Great West Promotions Inc. we have an art and design department plus we commision top artists/designers who work on the latest equipment and newest applications. By working closely with you and by carefully listening to your needs and goals, we are able to create an appropriate image to represent you, your company or organization.
Shipping Information
Orders are shipped FOB from their point of manufacture. Most of the time we will ship UPS. For items that are too large or too heavy, we will send them via trucking line and you will be notified.
We are able to deliver to most locations in the Canada and the United States. However, due to UPS and carrier restrictions, we cannot deliver to PO boxes, APO, or FPO addresses.
If you would like to have us ship your order and bill it to your account, we ask you to provide us with the carrier name and the account number in the comment area in the order confimration.
In all cases where you have not specified a third party billing account, we will add the freight to the invoice. All shipments require a signature to receive, and UPS shipments are sent insured.
Great West Promotions Inc. ships from multiple facilities throughout the world. If you have ordered multiple items, they may ship from different facilities. As a result, they may arrive to you at different times and in separate shipments.
Should the items be lost or damaged in transit when using third party billing, Great West Promotions Inc. is not responsible for damages incurred to the shipment. All claims or charges must be filed by you with your freight carrier. We will be happy to assist you in any way with any problems that you may encounter. Delivery Times
How long will it take for you to get the items you ordered? There are a couple of factors in this equation. You need to consider the time it takes to produce your item and the shipping method you selected.
Example: Production time + Shipping time = Delivery time
You order 100 mugs with a production time of "10 business days" and choose ground shipping. Ground shipments take 7 to 10 business days to arrive. So you have the 10 production days plus the 7 to 10 days for shipment you have a total delivery time of 17 to 20 business days.
We can normally produce and ship your item within the quoted time. When there is a problem with producing an item within the quoted time, we will notify you.
Production time is based on receiving your order with valid method of payment and design information. On orders where you have requested Samples and Pre-Production Proofs, the production timing begins when we receive your approval. All times reflect business days.
Payment Options
We Offer Several Easy Ways to Pay for Your Merchandise
Great West Promotions Inc. accepts the following methods of payment: credit cards, Interac (in-store only), company cheque, PayPal, Visa and MasterCard or cash.
Cash or cheque in advance:
For those customers who do not wish to use a credit card, we will require payment prior to manufacturing your order. When paying by cheque, the order will not be commenced until the cheque clears our bank.
All prices on the site are quoted in Canadian dollars.
Order Changes/Cancellations
Great West Promotions Inc. will make every effort, upon your request, to change or cancel your order. If the order has not yet started the production process, no additional change or cancellation fees will be applied. In the case of changes, the setup fees may vary from the original quote depending on your requirements.
If the order has reached the pre-production set up phase, there may be cancellation or change charges that apply. All of these charges will be a direct pass through from the manufacturer to you. In the case of changes, the setup fees may be different depending on your requirements.
If an item has begun production, unfortunately, we cannot stop or change the order. We can, if you wish, prevent shipment or redirect it. You will be charged the original amount quoted for all orders cancelled at this stage.
Terms and Conditions
Great West Promotions Inc. will extend credit to approved customers only. A credit check will be performed based upon information submitted with your order profile, and an appropriate line of credit established. We will notify you when your account is approved, generally within three (3) business day from when you submitted your application. In the event that you do not meet our minimum credit requirements, there are other options available to you. Your Sales or Customer Service Representative will contact you to discuss those options.
Standard payment terms are net 30 days - all payments are due 30 days from the date of invoice. You will be invoiced when the last item on your order is shipped.
If you have an existing account, there are conditions under which your account may be placed on credit hold:
If your account is over 30 days past due
If a check is returned for Non Sufficient Funds
In the event of a debt being turned over to third party collections
If the combined amount of multiple orders exceeds your approved credit limit
Terms and Conditions
Applicant authorizes Great West Promotions Inc. to investigate its credit history and understands that Great West Promotions Inc. may also utilize other sources of credit that it considers necessary. Such information will be held in strictest confidence. Applicant agrees to indemnify and hold Great West Promotions Inc. or any other person harmless from all liability, damage, or expense arising from or relating to any and all credit investigation. Applicant allows that the findings of this investigation may not necessarily result in an approved line of credit, and may result in deposit, prepayment, or further security demand, or even termination, regardless of activity status.
Buyer agrees to pay Seller the sales tax or other taxes imposed on the sale of goods or provide Seller with acceptable tax exemption certificate.
In all cases where we have a check returned for Non Sufficient Funds we will assess a $50.00 fee.
A 1.5% finance charge or the maximum permitted by law may be assessed against all accounts with past due balances. The Buyer agrees to pay all the company's reasonable attorney's fees and all collection agency fees incurred in the collection of any amount owed thereunder and not paid when due.
Seller is not to be accountable for delays in delivery occasioned by acts of God or other circumstances over which Seller has no direct control. Factory shipment or delivery dates are the best estimates of our suppliers, and in no case shall Seller be liable for any consequential or special damages arising from any delay in delivery.
Seller warrants that all goods sold are free of any security interest and will make available to Buyer all transferable warranties made to Seller by the manufacturer of the goods. Seller makes no other express or implied warranties, and specifically makes no implied warranties of merchantability or fitness for purpose.
In those instances where the Buyer is specifying a specific carrier and the freight is not being added to the invoice, all goods become your property at the time it is accepted by the carrier.
The failure of Seller to insist upon the performance of any of the terms or conditions of this contract or to exercise any right thereunder shall not be deemed to be a waiver of such terms, conditions or rights in the future, nor shall it be deemed to be a waiver of any other term, condition, or right under this contract.
No terms and conditions other than those stated herein, and no agreement or understanding, in any way purporting to modify these terms and conditions, shall be binding on Seller without the Seller's written consent.
The invoice is a conditional acceptance by the Seller of the Buyer's offer to purchase Seller's goods. It may contain terms, which differ from or add to those contained in the Buyer's purchase order, and to the extent that this is the case, the seller hereby expressly conditions its acceptance of the Buyer's offer on the Buyer's assent to the additional or different terms. The Buyer's receipt and retention of the goods covered by this invoice shall constitute acceptance of any such additional or different terms. The Buyer and Seller agree that any contract hereby entered into has been made and is to be construed to Canadian Law.
By submitting a purchase order to Great West Promotions Inc. you agree to all the terms and conditions as set forth by our terms and conditions.
Returns
Great West Promotions Inc. wants to take care of you.
We at Great West Promotions Inc. stand behind our products*. If you wish to return an item, please contact Customer Service at 1-877-939-5916 or top100@greatwestpromotions.com. Customer Service is staffed from 9:00 am to 5:00 pm (MST) Monday through Friday.
DO NOT return the items to an address on the packing materials or Web site. In many cases the facility processing the return will not be the same one that shipped the goods. Customer Service will provide you with the specific information you need. We will be happy take care of any concerns you may have at that time.
Pre-production Proofs
A pre-production proof is a production sample. When you place your order you can request a pre-production proof on certain items. We will make one sample with your custom imprint that will be shipped to you just prior to your order being produced. Once you approve the sample, your order will be manufactured in standard production time. If this is a service you need, please call us to make arrangements.
Satisfaction Guarantee
Great West Promotions Inc. wants you to be completely satisfied with your purchase. To ensure we meet this standard, we offer only premium, branded merchandise. If you are not completely satisfied with your promotional product purchase, please call 1-877-939-5916 or top100@greatwestpromotions.com within 15 days of your purchase's arrival and we will resolve the issue.

Rush Orders
In a hurry, we have products with a production time of 3 days. These items can be manufactured in three working days and then be on their way to you.

By working with our manufacturers, we will try to speed a product through that will meet your requirements. In many cases, additional charges are associated with rush orders and they will be quoted separately.
Minimum Quantities and Less than Minimum orders
Minimum quantity requirements vary from manufacturer to manufacturer. In cases where a manufacturer's minimum order requirement exceeds your requested quantity, a Great West Promotions Inc. Specialist will assist you. Short production runs can be arranged (at a higher cost per unit) and our team is happy to provide a special quote or other recommendations to get you the right product.
